- The Settlement:3M agreed to pay $6 billion to resolve the lawsuits, with payments to claimants expected to occur between 2023 and 2029.
- Settlement Details:
- The settlement includes $5 billion in cash and $1 billion in 3M common stock.
- 3M has stated that the settlement is “not an admission of liability” and that the company is prepared to continue to defend itself in the litigation if certain agreed terms of the settlement agreement are not fulfilled.
- Claimant Eligibility:
- The settlement covers veterans and service members who used the Combat Arms earplugs during their military service and who are experiencing hearing loss or tinnitus.
- Claimants must register to participate in the settlement.
- Settlement Management:
- The settlement agreement is being managed by litigation management firm BrownGreer.
- A website, www.combatarmssettlement.com, has been set up for claimants to track the settlement.
- Aearo’s Role:
- The earplugs were manufactured by Aearo Technologies, a company 3M acquired in 2008.
- Aearo filed for bankruptcy in 2022 in an attempt to limit its liability, but that move was dismissed by a judge.
- Key Dates:
- The settlement agreement was reached in August 2023.
- 3M began issuing payments to claimants in January 2024.
- The settlement is expected to be fully implemented by 2029.
